The agreement between us, in plain language.
These terms apply when you book an evening with us or use this website. Booking an evening means you accept them.
Our booking terms cover deposits, cancellations and what happens on the night. This page covers everything else.

Who we are.
Maison des Amis is a sole proprietorship registered in Ontario, Canada, operating from Toronto.
Where these terms say we, us or our, they mean Maison des Amis. Where they say you or the host, they mean the person who makes the booking.

When the agreement starts.
An enquiry is not a booking. The agreement between us begins when you have confirmed a date and paid the deposit, and we have confirmed it back to you in writing.
Prices shown on this website are current at the time of publication and may change. The price that applies to you is the one confirmed at the time of your booking.
We can decline a booking. We may do that if a date is unavailable, if the space is not workable, if a dietary requirement cannot be met safely, or if we do not think we can deliver the evening properly.

Your responsibilities as host.
You are the host, it is your home and they are your guests. That means a few things sit with you.

Giving us accurate information on the intake form, particularly about allergies, guest numbers, your table and your power supply

Telling your guests that we film and photograph, before the evening rather than during it

Providing safe access to your home, and a space that is safe to work in

The behaviour of your guests, including anything they damage

Making sure anyone drinking is nineteen or over

Buying the alcohol yourself, if there is going to be any
If the space or the guest numbers turn out to be materially different from what you told us, we will do our best on the night, but we may not be able to deliver the evening as described and no refund is due.

Our responsibilities.

Turning up on the agreed date, at the agreed time, with everything we said we would bring

Holding valid food handler certification and preparing all food in an inspected commercial kitchen

Holding Smart Serve certification for anyone serving alcohol

Carrying commercial general liability insurance

Treating your home and your belongings with care, and leaving the kitchen cleaner than we found it

Telling you honestly and early if something changes

Alcohol.
We do not sell, supply or provide alcohol under any circumstances. There is no licence available in Ontario that would allow us to do so in a private residence.
Any alcohol at your evening is bought by you, owned by you, and remains your property in your home. Our staff pour and serve it as your hired server, in the same way a bartender would at any private party.
Everyone serving holds Smart Serve certification and will card anyone who appears under twenty-five. They can refuse service to any guest and can stop service entirely if the room becomes unsafe. That decision is theirs and it is final. It is not grounds for a refund.

Safety in your home.
Our evenings involve heat, boiling water, knives and, on some formats, open flame. Guests take part voluntarily and at their own risk.
Our hosts will give safety instructions and guests are expected to follow them. We can ask a guest to stop taking part, and we can end the evening early, if we believe someone is at risk. Where we end an evening for safety reasons, no refund is due.
Children under nineteen may be present but may not drink alcohol and may not take part in any part of the evening involving heat, flame or blades.

Liability.
We carry commercial general liability insurance and we take responsibility for our own negligence. If we damage something in your home, we cover it.
Except where the law does not allow us to limit it, our total liability in connection with any booking is limited to the amount you paid us for that booking.
We are not liable for indirect or consequential losses, or for anything caused by inaccurate information given to us, by a guest's own actions, or by a guest failing to follow safety instructions.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Ontario or Canadian law. If you are a consumer, nothing here removes rights you have under the Ontario Consumer Protection Act.
If a claim comes from your side
If someone brings a claim against us because information you gave us was wrong, because of something one of your guests did, or because these terms were broken, you agree to cover our reasonable costs in dealing with it.
This does not apply to anything caused by our own negligence, and it does not apply where the law does not allow it.
Allergies
We work entirely from the intake form. We cannot guarantee any dish is free from a given allergen, because our food is prepared in a shared commercial kitchen where nuts, dairy, gluten and other allergens are present.
If an allergy is not declared before the evening, we will decline to serve that guest rather than guess.

Photographs and content.
We film and photograph at every evening. This is stated in your booking terms and repeated in your confirmation.
By booking, you agree that we may use photographs and video from your evening in our marketing, unless you opt out. You can opt the whole evening out at booking, at no cost. Any guest can opt out on the night and we will keep them out of frame.
We will never publish a recognisable face without your agreement at booking, and we never name or tag a private address.
Photographs we send you are yours to share personally. Everything on this website, including our text, our recipes, our recipe cards and our images, remains ours and may not be reproduced commercially without written permission.

Using this website.
We keep this website as accurate as we can, but we do not guarantee it is always complete or up to date. Prices, availability and format details can change.
You may not copy, scrape or reuse the content of this website for commercial purposes without our written permission.

Privacy.
We collect only what we need to run your evening, including your contact details, your address, and the answers you give on the intake form. Allergy information is collected because it is necessary to serve you safely.
We do not sell your information. Full detail is in our privacy policy.

Things outside anyone's control.
Neither of us is responsible for failing to perform because of something genuinely beyond our control. That includes severe weather, power failure, illness, government restrictions and similar events.
If we cannot run your evening for one of those reasons, you get a full refund plus a twenty per cent credit against a future booking, as set out in our booking terms.

Governing law and changes.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. Any dispute will be dealt with by the courts of Ontario.
We may update these terms. The version that applies to your booking is the one published when you booked, and we will tell you if anything material changes before your evening.
If any part of these terms turns out to be unenforceable, the rest of them still apply.
